Where goods, services, transactions, fulfillment activities, deliveries, or provider interactions involve independent third parties, users acknowledge that such activities are carried out by independent participants and not by Crestsek directly.

Crestsek may monitor platform activity and maintain enforcement systems relating to providers, vendors, businesses, merchants, users, and independent operators.
Participants may be restricted, penalized, suspended, or permanently removed for fraud, abuse, poor performance, misconduct, platform manipulation, or violations of these Terms.
Crestsek maintains full authority over platform enforcement systems, ratings and review systems, access permissions, operational controls, and internal moderation decisions. All enforcement decisions are final, except where otherwise required by applicable law.

All content, features, and functionality available on the Platform — including software, system architecture, design, text, graphics, logos, and operational logic — are the exclusive property of Crestsek or its licensors.
You are granted a limited, non-exclusive, non-transferable right to use the Platform strictly in accordance with these Terms.

Crestsek reserves the right to modify, update, or discontinue any part of the Platform; change features, pricing, or service availability; or introduce new functionalities without prior notice. We are not liable for any impact these changes may have on your use of the Platform.
The Platform relies on third-party systems such as payment processors, GPS and location services, and communication tools. Crestsek is not responsible for errors, downtime, or inaccuracies arising from these services.
To the maximum extent permitted by applicable law, Crestsek shall NOT be liable for service failures, loss or damage of goods, provider or vendor misconduct, payment issues, or system outages and interruptions.
All Services are provided "AS IS" and "AS AVAILABLE". Use of the Platform is entirely at your own risk.
All disputes must first be submitted to Crestsek for internal review. Crestsek reserves the right to investigate and resolve disputes at its discretion and make final decisions on all claims. Users agree not to initiate external claims without first completing internal resolution.
Nothing in this section shall limit a user's rights where such limitations are not permitted under applicable law.
Crestsek may suspend or terminate access at any time and remove users or providers without notice for any violation of these Terms.
We may update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
Crestsek shall not be liable for any delay, failure, or disruption in the performance of Services resulting from events beyond its reasonable control, including acts of God, government actions or regulatory restrictions, strikes or civil unrest, network or infrastructure failures, or fuel shortages and transportation disruptions. During such events, Crestsek's obligations under these Terms shall be suspended for the duration of the event, without liability.
Users agree NOT to use the Platform for activities involving:
Crestsek reserves the right to refuse or terminate transactions, restrict platform access, suspend or terminate accounts, and report suspected unlawful activity to appropriate authorities. Users bear full responsibility for all activities conducted through their accounts or through their use of the Platform.
Where transactions, fulfillment activities, provider coordination, deliveries, or service operations cannot be completed due to user error, provider limitations, operational issues, or third-party actions, Crestsek may at its discretion:
Additional costs arising from failed transactions, inaccurate information, user actions, or third-party failures may be borne by the responsible user or participant. Refund eligibility, where applicable, shall be determined in accordance with Platform policies and applicable law.
Crestsek reserves the right to suspend, restrict, or terminate any account at its sole discretion, with or without prior notice. Crestsek shall not be liable for any loss arising from such actions, including loss of data, loss of transactions, business interruption, or indirect or consequential damages.
Nothing in these Terms shall be deemed to create an employer-employee relationship, a partnership or joint venture, or an agency relationship between Crestsek and any user, provider, or vendor. All parties operate independently and are solely responsible for their own actions.
Crestsek reserves the right to monitor transactions and platform activity, investigate suspicious or fraudulent behavior, suspend or block accounts or transactions, and report suspected fraud or illegal activity to appropriate authorities. Any user found engaging in fraudulent, abusive, or unlawful conduct may be permanently banned from the Platform.
To the fullest extent permitted by applicable law, Crestsek shall not be liable for any indirect, incidental, or consequential damages. Where liability cannot be excluded, Crestsek's total liability to any user shall not exceed the amount paid by the user for the specific transaction giving rise to the claim.
